Dank der Bemühungen der Europäischen Kommission (JRC, SANTE, MARE) und der Gesundheitsbehörden der EU-Mitgliedstaaten wurde der EU-Katalog für neuartige Lebensmittel um eine ganze Reihe neuer Algenarten ergänzt.
Bislang wurden in der EU nur sehr wenige Algenarten als nicht neuartige Lebensmittel oder nicht neuartige Nahrungsergänzungsmittel zugelassen (etwa 20). Vertreter der Industrie haben dies mehrfach als einen wesentlichen Engpass anerkannt, der die Entwicklung des Algensektors in der EU bremst. Das Problem: Die Einführung einer Algenart als Lebensmittel oder Nahrungsergänzungsmittel auf den EU-Markt ist gemäß der Verordnung über neuartige Lebensmittel mit einem langwierigen und kostspieligen Verfahren verbunden.
Liegen jedoch Nachweise dafür vor, dass eine Algenart vor dem 15. Mai 1997 in einem EU-Mitgliedstaat als traditionelles Lebensmittel verwendet wurde, gilt ihre Verwendung in Nahrungsergänzungsmitteln nicht als neuartig und unterliegt somit nicht der Zulassungspflicht vor dem Inverkehrbringen gemäß der Verordnung über neuartige Lebensmittel (EU) 2015/2283.
Das JRC hat in seinem Bericht aus dem Jahr 2021 eine Zusammenstellung solcher Arten erstellt.
Auf der Grundlage der in diesem Bericht verfügbaren Erkenntnisse leitete SANTE ein Validierungsverfahren mit den Gesundheitsbehörden der EU-Mitgliedstaaten ein, das zu einer erheblichen Erweiterung der Liste der in der EU als Lebensmittel oder Nahrungsergänzungsmittel zugelassenen Algenarten führte. Mehr als 20 neue Arten wurden in den Katalog für neuartige Lebensmittel aufgenommen, was der EU-Algenindustrie Kosteneinsparungen von mindestens 10 Millionen Euro einbrachte.
